Parental Consent Form

1. Introduction

This Parental Consent Form is required for children under the age of 13 to use the XAM assessment platform. In compliance with the Children's Online Privacy Protection Act (COPPA) and other applicable child privacy laws, we require verifiable parental consent before collecting personal information from children.

Note: This form must be completed and signed by a parent or legal guardian before the child can participate in assessments on the XAM platform.

2. Information We Collect from Children

When a child under 13 uses our platform, we may collect the following information:

Personal Information

  • Child's name (first and last)
  • Email address (child's or parent's)
  • Grade level and age
  • School or organization affiliation

Assessment Data

  • Assessment responses and answers
  • Performance scores and results
  • Time spent on assessments
  • Progress and completion status

Proctoring Data (if enabled)

  • Video recordings during proctored assessments
  • Audio recordings
  • Screen recordings
  • Device and browser information
  • Activity logs and session data

3. How We Use Children's Information

We use information collected from children solely for:

  • Assessment Delivery: To provide and administer assessments
  • Performance Reporting: To generate reports for parents, teachers, or administrators
  • Assessment Integrity: To ensure fair and secure testing conditions
  • Platform Functionality: To enable account access and save progress
  • Support: To respond to parent or school inquiries

We do not:

  • Sell children's personal information
  • Use children's data for advertising or marketing
  • Share children's data with third parties except as necessary to provide the service
  • Create public profiles for children

4. Data Sharing

Children's information may be shared with:

  • Assessment Creator: Teachers, schools, or organizations that create assessments
  • Parents/Guardians: Upon request, parents can access their child's data
  • Service Providers: Trusted third parties who help us operate the platform (e.g., cloud hosting)
  • Legal Requirements: When required by law or to protect safety

5. Data Security and Retention

Security Measures

  • End-to-end encryption for all data
  • SOC 2 Type II certified infrastructure
  • Role-based access controls
  • Regular security audits

Retention Periods

  • Assessment Data: Retained while account is active, deleted within 30 days of account deletion
  • Proctoring Recordings: 90 days maximum
  • Activity Logs: 12 months

6. Parental Rights

As a parent or guardian, you have the right to:

  • Review: Request to review your child's personal information
  • Delete: Request deletion of your child's personal information
  • Refuse: Refuse to allow further collection or use of your child's information
  • Withdraw Consent: Withdraw this consent at any time
  • Be Notified: Receive notification of any material changes to our practices

7. Assessment Maker Responsibility

Important: It is the responsibility of the assessment creator (teacher, school, organization, or institution) to:

  • Identify participants who are under the age of 13
  • Distribute the appropriate consent form to parents or guardians
  • Collect completed and signed consent forms
  • Submit the consent forms to XAM before the child participates in assessments
  • Maintain records of consent for their organization
  • Notify XAM if consent is withdrawn by a parent

XAM will not permit children under 13 to participate in assessments without valid parental consent on file.
